Sorry if I am posting on wrong thread. I am in the process of sending my documents for EAD renewal and had few questions
Do we need to include a cover letter ?
Also I am sending the following documents.
1) copy I-485 receipt notice
2) copy of EAD (front and back)
3) two color photos
4) Filing fee check $340
5) Mailer stub received from previous EAD.
Am I missing anything else?

No I have no proof to substintiate that, but I have read it on few forums here and there, I live in a very small city in NY, I know atleast 15 people with their PD in early 2003, That tells me the extent of problem, how many would there be in NJ, CA, IL, TX, VA etc. The only relief would be people who would convert to EB2 and leave that space. Labor Substition was a devil which has created most of this problem as I can see there are hardly 15-20% original beneficiaries for these 2002-2003 Labors.
Are we sure that there are around 5-6k EB3 pending in the years 2002 and 2003. If thats true then it will take atleast 6 more years to process all the EB3's for 2002 and 2003 :(

Consider the scenario:
Two guys (A and B) come to US in 2005, both do not have MS and experience less than 5 years. Therefore both not elligible for EB2 on 2005. They are from a retrogressed country.
A does MS and joins job in 2007, becomes eligible for EB2 and files GC on 2007.
B joins a job on 2005 that do not need MS and experience and files for EB3.
Till 2010 both of them did not get GC. But B crossed 5 years of experience and from EB3 to EB2. Now B's priority date is 2005, although he was not elligible for EB2 at that time.
Although A was elligible for EB2 in 2007 earlier than B (2010), A is pushed behind B.
SHould it be acceptable to people like A? And there is not one or two pleale like B, thousands arer doing that?
If you see my priority date you will understand I am not saying this for myself. I have a bro and friends who are facing this isssue.
Therefore EB2s who are from mid 2006 onwards will really get pushed back..
I see this porting simillar to the labor substitition.. Till it was in place it was legal although thousands bought labors and that is one main reason EB2 had retrogressed back to 2000. I predict simillar thing is happending again, people are paying money to the desi employers to file perm in EB2 again pretty soon same tertrogression will happen to EB2 I if any urgent action is not taken.
I hace passed this stage.. now its for you all to decide..

You can't compare porting with labor substitution. For porting, you have to go through the complete process and not just throw some dollars.

It's the ignorance of process, if you are eligible for EB2 .. go join any other company.. it's America .. for God's sake..

I read this as moste h1 extensions are being denied, and think to myself, why are we so sruprised. The body shoppers abuse the system for such a long time, they had it coming to them. But so what, people who are being affected by this are the poor consultants themselves, who put all their trust in these body shoppers and in some cases paid high amounts to come to US. BOdy shoppers are not being affected by this in anyways. They should be fined if the US rejects an H1 for illegal hire. I just hope that consultants are given enough time to apply at other places.
I was also denied h1 extension some 3 years ago. Mine was because of criminal record. i appelaed and denial was approved and USCSI admitted to the the fact that they made a mistake. I was lucky and I knew what the law stated about my criminal record. You can search the forum and will find out what I am talking about. so to all who have been rejected, please research the if the denial is wrong then please file appeal. In most cases, the appeal will be reviewd the driector of the district. So please dont give up.

8/19/2008(Monday) 7 AM: Got "Welcoming the new Permanent resident.." email, saying 485 was approved on 8/18/2008.
8/19/2008(Monday) 9 PM: Got "Card production Ordered" Email.
8/22/2008(Friday) 1 PM: Got "Approval Notice Sent" Email.
8/23/2008(Saturday) : Got Physical Welcome notice on I797 form, mailed by USCIS on 8/18/2008

Hello All,
Talked to my lawyer today about the checks; they have been encashed for myself and my spouse on 9/4. My RN starts with SRC.
My I-140 was approved from Texas and my AOS/485 was mailed on july 2nd and arrived on july 3rd to NSC.
Just a curious question for those you have already received their RN#. When checking the case status it displays "I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS "...will this message change when EAD has been approved and mailed?

the different initiatives that IV has taken up for EB3, which I guess you are not aware of.
As you don't want to donate or volunteer what makes you think that you can tell IV on what to do and what not to do.. Are you even associated in anyways.
I have never ever seen such a big thankless following of a group. Everyone is in trouble and everyone has problem but cannot donate.
Wanted to write a lot more , but I think its not worth it. I just hope your conscious makes you feel ashamed of this attitude of yours.

If 485 can be filed for both primasy and dependent when EB is current or FB is current
this will really work pretty well. dependents can be on EAD/AP status in this case.

i.e. assume my PD is X. If X is current in FB category but not in EB category - both the primary and the dependent should still be able to file I485. Same happens if X is current in EB and not in FB.
In this scenario - if the family based category is retrogressed:
Option 1: Spouce can wait the retrogression out in AP/EAD.
Option 2: Primary can become a citizen in 5 years and then "upgrade" the I485 to a new FB category with no retrogression.
Without this joint filing if either category is current - it can cause nightmares for the dependent if the primary gets a GC and the dependent loses H4/L2.

All EB categories will be current all the time. As soon as a I485 EB case is filed the visa number should be allocated to the first 8000 odd cases for that category based on the PD of application. If a new case is filed tomorrow with a old PD he will get the visa number and the last guys application will move to waiting list. At the beginning of the year all visa numbers are allocated and nothing is wasted, even if the case is having issues like RFE, FBI check, etc the applicant knows that once cleared he will get his GC.
Can you explain why you think the lawyers will laugh it off? Or is it just that you say it because someone is saying something which you don't agree with?
A clarification regarding the flower campaign. I said the AILA law suit and the congresswomen letter to the chief also had lot of weight. It is just not the flower campaign for your information, if you beleive so it is your opinion just like I have mine.

I just wanted to disagree the with title of the thread.. All EB3 is "U" why only call to action for EB3-I.. Please dont limit your view of the world(in this case IV)...Work for the betterment of all in EB3 and EB2 and all EB categories....

There are several restrictions/constraints for many ppl for not being able to devote time/money for the general cause. Let's not fret about the reasons. While it would help for all ppl to join forces that should not distract the group that is doing something about the issues.
And ppl on the sidelines - pls don't be a passive professional critique. However valuable your comments and ideas are they are useless without acting upon it - they are just like seeds sown in a barren land. The good work of the forum will continue without your presence. With your involvement we all can reach the goal that much more faster.
My Labor certification is actually filed in the state of IL. But i am on an assignment in MD till Sep 2010 (after filing for relevant amendments).
It's ~5 hrs drive for me to Baltimore/Washington-DC. So, coming every week for a meeting is not practical. I am extremely eager to support OUR cause given the commuting constraints. I have already written to our congress man here to bring to his notice the struggles of wannabee immigrants.
So, where do i sign up?
